Rental terms
- To secure and confirm the reservation, an advance payment of 50% of the total reservation amount is required.
- The remaining amount of 50% from the total reservation price will be charged 15 days before arrival.
- The guest can cancel for free 25 or more days before arrival.
- If cancelled within 25 days before arrival, the guest will be refunded 90% of the total amount paid.
- If the guest does not show up on the arrival date, we will not refund the paid amount.
- The deposit is 500,00 € and must be paid upon arrival.
- 1. General provisions
These General Rental Terms govern bookings, payment, cancellation and stays at the Villa Marcello holiday home in Zadar (the “Property”). The Property is owned and let by Futura Mansio d.o.o., OIB 31549978941, with registered office at Federica Grisogona 9, 23000 Zadar (the “Host”). Contact: [email protected].
By confirming a booking, the Guest confirms that these Terms were received or available before the contract was concluded, and that the Guest understands and accepts them. The person making the booking must inform all group members and visitors of these Terms.
2. Definitions
• Guest: the person making the booking and, where applicable, all persons included in it.
• Booking: the agreed stay for a specified period, number of guests, price and scope of service.
• Platform: an intermediary online platform through which the booking is made.
• Security deposit: security for damage, missing inventory, exceptional cleaning or other amounts owed by the Guest.
3. Booking
A booking becomes binding after the Host issues written confirmation and, where applicable, receives the agreed advance payment. Until then, an enquiry or offer is not a guaranteed reservation.
The Guest must provide accurate details of the lead guest, the number and identity of guests and any information required for statutory registration. Only registered persons may use the Property, up to the maximum occupancy stated in the booking confirmation.
For bookings made through a platform, the platform confirmation and specific rules apply to payment, cancellation and communication. If provisions conflict, the term expressly confirmed for the booking applies, subject to mandatory law.
4. Price and payment
All prices are stated in euros (EUR). For direct bookings, 50% of the total price is payable as an advance and the remaining 50% no later than 15 days before arrival, unless the booking confirmation expressly states otherwise.
If payment remains outstanding after a reasonable reminder, the Host may terminate the booking and apply the agreed cancellation policy. Bank or payment-method charges are borne by the payer unless the law provides otherwise.
Tourist tax, taxes, fees and included services are specified in the booking confirmation and governed by applicable law. The Host issues an invoice as required by law.
5. Cancellation and booking changes
For direct bookings, the following policy applies unless another rate is expressly agreed in the offer or confirmation:
• cancellation 25 or more days before arrival: refund of all amounts paid, with no cancellation fee;
• cancellation less than 25 days before arrival: refund of 90% of the total amount paid;
• no-show on the arrival date or voluntary early departure: no refund, unless mandatory law requires otherwise.
Cancellation must be submitted in writing and takes effect when received by the Host. If the cancelled period is re-let, the Host may grant an additional refund in light of the circumstances and the loss actually avoided.
Changes to dates or guest numbers require written approval and may affect the price. For platform bookings, the cancellation policy displayed and accepted on that platform applies.
6. Security deposit
The security deposit is EUR 500.00 and may be collected before arrival or at check-in, including by card pre-authorisation or another method notified in advance.
If inspection reveals no outstanding claim, the deposit or unused balance will be released or refunded within seven days after departure. The time required for funds to appear may depend on the bank or card issuer.
The Host may deduct reasonably documented costs for damage, missing inventory, replacement keys or access devices, cleaning beyond the normal scope and other due amounts. If the cost exceeds the deposit, the Guest must pay the difference following a reasoned request.
7. Arrival and departure
Check-in and check-out times are stated in the booking confirmation. Early arrival or late departure requires prior written approval.
• On arrival, inspect the Property and promptly report any apparent defect.
• On departure, lock the Property, close windows, switch off lights and air conditioning, and return all keys and access devices.
• Leave the Property reasonably tidy and dispose of waste as instructed.
Items found after departure are kept for 30 days. Where possible, return delivery is arranged at the Guest’s request and expense.
8. Guest obligations
The Guest must use the Property with due care, comply with instructions and safety rules, respect neighbours and public order, and immediately report any defect, danger, accident or damage.
• Do not admit unregistered persons without approval.
• Do not carry out unlawful or commercial activities.
• Do not move, dismantle or service equipment.
• Stop using defective equipment where continued use could increase damage.
• Ensure continuous adult supervision of children, especially around the pool and wellness equipment.
9. Host obligations
The Host provides the Property clean, safe and fit for the agreed use, with the equipment described in the offer, and provides reasonable assistance when a defect is reported.
The Host respects the Guest’s privacy. Entry is by prior notice and agreement, except where urgent access is necessary to protect persons or property, prevent serious damage or comply with a legal duty.
10. Use of the Property and quiet enjoyment
The Property is for the holiday use of registered guests. Guests must respect neighbourhood peace and noise restrictions in the house rules and local law. Excessive noise, disturbance and conduct endangering persons or property are prohibited.
The Host may require an immediate end to a breach. In the event of a serious or repeated breach, after a warning where reasonably possible, the Host may terminate the stay, without prejudice to a claim for actual damage and within the limits of applicable law.
11. Swimming pool
Use of the pool depends on each person’s own ability and compliance with safety instructions. Children and non-swimmers must remain under continuous, direct supervision by a responsible adult.
• No diving, jumping, running on wet surfaces or climbing on pool edges.
• No glass or breakable objects in the pool area.
• Do not alter settings, open technical components or add chemicals.
• Report every fault, contamination or accident immediately.
After prior notice, an authorised person may access the external technical area for routine or urgent maintenance while minimising interference with Guest privacy.
12. Jacuzzi
Guests should shower before using the jacuzzi and follow limits on occupancy, temperature and duration. Persons with medical conditions, pregnant persons and those receiving treatment should obtain medical advice before use.
• Do not use oils, foam, salts, food, glass or other unauthorised substances.
• Do not alter service settings, drain the water or remove protective components.
• Children may use the jacuzzi only under direct adult supervision and in accordance with the manufacturer’s instructions.
13. Sauna
Use the sauna according to the posted instructions and your health condition. Persons with cardiovascular or other medical conditions, pregnant persons and those receiving treatment should seek medical advice before use.
• Use a clean towel as a seat and body mat.
• Do not bring food, alcohol, glass or flammable items.
• Only water may be placed on the heater, and only where the instructions permit.
• Children may enter only under direct supervision by a responsible adult.
14. Smart Home, internet and multimedia
The Smart Home system, Wi-Fi, Alexa, televisions, Google TV, PS5 and other multimedia equipment may be used only for ordinary purposes and according to instructions.
• Do not reset devices or change administrator accounts or Wi-Fi settings.
• Do not disconnect network equipment, install unauthorised software or bypass security settings.
• Sign out of personal accounts before departure.
The Host does not guarantee uninterrupted internet or third-party digital services where disruption is beyond reasonable control, but will take reasonable steps after notice to remedy the issue.
15. Electrical and climate-control equipment
Use all equipment only for its intended purpose and according to instructions. Televisions, PS5, soundbar, Alexa and other equipment must not be moved, dismantled or serviced.
Keep windows and external doors closed while air conditioning operates. Turn off air conditioning and lighting during longer absences, except equipment that must remain on according to instructions.
16. Electric-vehicle charging
Electric vehicles may be charged only through the installed EV charger, in accordance with instructions and technical limits. Charging from domestic sockets, adapters or extension leads is prohibited. Report any defect or damage to the cable or connector immediately.
17. Pets
Pets are not permitted in the Property or its grounds, except assistance animals where required by applicable law. The Guest must notify the Host before arrival so that reasonable arrangements can be agreed.
18. Smoking, open flames and safety
Smoking and electronic cigarettes are prohibited indoors. Outdoors, they may be used only in a suitable location, with complete extinguishing and safe disposal of cigarette ends.
Candles, fireworks, portable barbecues and other open flames are prohibited, except equipment expressly provided by the Host with operating instructions.
19. Parties, events and commercial recording
Without prior written approval, parties, celebrations, bachelor or bachelorette events, organised events, gatherings beyond the booked group, commercial photography or filming, and use of the Property to promote products or services are prohibited.
20. Damage and liability
The Guest is liable for damage caused intentionally or negligently by the Guest, group members or visitors. This includes, without limitation, damage to floors, walls, joinery, furniture, kitchen, sanitary facilities, pool, jacuzzi, sauna, air conditioning, multimedia equipment, lighting, outdoor equipment, EV charger, Smart Home system and inventory.
Damage may be identified during the stay or after departure during the regular detailed inspection. The Host will reasonably explain and, where appropriate, document a claim with photographs, an invoice, service quotation or other evidence. Normal wear from proper use is not charged.
The Guest must immediately report water leaks, faults in the pool or wellness equipment, power failure, air-conditioning or internet faults and other hazards. A Guest who continues to use faulty equipment and thereby increases the damage is liable for the additional loss.
Nothing in these Terms excludes or limits liability that may not lawfully be excluded or limited, including liability for intent or gross negligence.
21. Privacy and video surveillance
There are no cameras inside the Property. No cameras are directed towards the swimming pool, jacuzzi, sauna, wellness area or any other area where Guests reasonably expect privacy.
If video surveillance is used to protect persons and property, it is limited to appropriate external access or security areas, with visible notice and processing in accordance with applicable law. A separate privacy notice available to the Guest must state the controller, purpose, legal basis, retention period and data-subject rights.
Data required for booking, guest registration, payment, safety and legal compliance is processed under applicable data-protection rules. Rights may be exercised using the contact stated in the booking confirmation or privacy notice.
22. Extraordinary circumstances and service interruptions
A party is not liable for non-performance caused by an extraordinary, unforeseeable and unavoidable event beyond its reasonable control, to the extent permitted by law. Examples include natural disasters, fire, flood, earthquake, war, authority decisions and major interruptions of public utilities.
The affected party will notify the other without undue delay and take reasonable steps to mitigate consequences. Rights to a price reduction, substitute accommodation, termination or refund depend on the circumstances, the contract and mandatory law; this clause does not remove statutory Guest rights.
23. Complaints, governing law and disputes
The Guest should report a defect promptly during the stay and allow a reasonable opportunity to remedy it. Written complaints may be sent to [email protected] or to Futura Mansio d.o.o., Federica Grisogona 9, 23000 Zadar. The Host will acknowledge receipt and respond within the statutory period.
The contractual relationship is governed by Croatian law, without depriving a consumer of mandatory protection under the law of the consumer’s country where applicable. The parties will first attempt an amicable settlement. Court jurisdiction follows applicable rules; these Terms do not restrict the consumer’s statutory right to a competent court or available alternative dispute-resolution mechanisms.
24. Final provisions
These Terms apply to bookings for stays beginning on or after 1 July 2026 where made available and accepted in due time. Earlier confirmed bookings are governed by the version accepted when booked, except changes favourable to the Guest or required by law.
If any provision is void or unenforceable, the remaining provisions remain effective and the invalid provision is replaced by a legally permissible rule closest to its purpose.
The Croatian version prevails unless another language version is expressly accepted for a particular booking. The Host may amend these Terms for future bookings by publishing a new version and effective date. Changes do not apply retroactively to an existing contract without Guest consent unless required by law.

Appendix A — House Rules
Essential rules for a peaceful and safe stay.
• Only registered guests may stay; visitors require prior approval.
• Respect neighbourhood peace and local noise rules.
• Parties, events and commercial recording require written approval.
• Pets are prohibited, subject to statutory assistance-animal exceptions.
• No smoking indoors.
• Children require continuous adult supervision, particularly near the pool and wellness area.
• Report faults, damage, leaks or hazards immediately and stop using defective equipment.
• On departure close windows, turn off air conditioning and lights, lock the Property and return access devices.
Appendix B — Pool Rules
The pool is not continuously supervised by a lifeguard.
• Use the pool according to your ability; non-swimmers require direct supervision.
• Never leave children alone in the pool area.
• No jumping, diving, running or pushing.
• No glass or breakable items.
• Do not touch technical equipment or change settings.
• Report contamination, defects or accidents immediately.
Appendix C — Sauna Rules
Use the sauna reasonably, according to instructions and your health condition.
• Shower before use and place a clean towel underneath you.
• No food, alcohol, glass or flammable items.
• Add only water to the heater and only where permitted.
• Stop immediately if you feel dizzy, weak or unwell.
• Children require direct adult supervision.
Appendix D — Jacuzzi Rules
Hygiene and correct use protect Guests and equipment.
• Shower before entry and observe occupancy limits.
• Do not add oils, foam, salts or other substances.
• No glass, food or drinks.
• Do not change service settings or drain the water.

• Sign out of personal accounts before departure.
